While studying in Australia, many foreign students will want to work during their time spent studying in the country. Work rights condition 8105 states that before the holder's course of study commences the holder must not engage in any work in Australia. Once your programme has commenced and is in session a student visa allows you to work up to 40 hours per fortnight and when your programme is not in session unrestricted hours. Up to 90 days before to their course begins they are allowed to arrive in Australia, but until their courses have begun students are not allowed to begin working. The period of 14 days commencing on a Monday means fortnight.
An example of calculation of 40 hours a fortnight. Student visa holder after their course has commenced works for following number of hours:
- 15 hours work – week one
- 25 hours work – week two
- 25 hours work – week three
- 10 hours work – week four
In the above example, The Total worked is more than 40 hours in week two and three. This may be subject to visa cancellation because the student is non-compliant with the work limitation. You can work full time when:
- As requirement of the course to work that was specified when the course for overseas students and course particular were entered in the commonwealth Register of Institutions.
- If the student visa holder has commenced the master degree by research or doctoral degree.
Student work hour restriction:
- Coursework students who have started their degree, when the course is in session – work for 40 hours per fortnight & when the course isn't in session – work unlimited hours.
- Research students who have started their degree when the course is in session – work unlimited hours.
- AusAwards or Defence students – When course is in session – work for 40 hours per fortnight & when course isn't in session – work unlimited hours
Secondary Applicant's on student visas:
When the main student commences studies, then work rights for secondary visa holders come into effect. As a condition of 8104, your partner can work full time covering both masters by coursework and research even though 8105 which is for the main applicant only allows for master by research or doctoral students for full time work.
For family member visa holders under condition 8104 per fortnight You can work up to 40 hours. It means starting on a Monday a 14 days period. You must not start work Until the main student visa holder has started their course
Exceptions –
Family members of the primary students can work unlimited hours, after the main student visa holder has started their course
- Students studying for a doctorate degree.
- Students studying a research degree or master’s by coursework
Working in Australia after completion of study:
